Code CC
A CC claim pays 32.5 miles, and to get this claim paid, you must VTR the defect prior to departing. I also suggest using the MTR after it is reported on the VTR. Document the time you called and the time you departed. You also need to document who authorized you to depart with the defective locomotive. Give a descriptive account of what the defect is. If it is a toilet claim, describe what makes the toilet unsanitary. A flapper missing or broken is not a claim. A broken fridge is not a claim. Engineer’s get a claim for lack of cool potable water. If you have ice and a place to store water with the ice, you do not have a claim. You may claim a CC on all lead motors. I will hash out its validity in claims conference. Foreign Locomotives received in interchange, and you are the 1st BNSF crew on it, are difficult to get approved. If you get the train on foreign territory with foreign power, you will not get the claim paid. I would like to have the opportunity to argue the claims anyhow, account foreign motors that will traverse BNSF territory with a BNSF crew are still beholden to the minimum FRA standards. I believe the BNSF has a responsibility to ensure their crews have the minimum FRA standards. According to board award 458 and the Federal Code of Regulations, you are due a CC for the following defects under the following circumstances.
Example
CC claim allow 32.5 miles account lead engine BNSF 7666 on STACCHC122B (VTR 0041 DEP0222 YM DG) had a full toilet splashing fluids on bathroom floor unavoidable from standing in when using bathroom. This caused an unsanitary condition for the crew. The train is a BNSF originating train, and passed several mechanical facilities and was not pumped. The BNSF is responsible for providing a sanitary toilet. The BNSF must maintain and provide a sanitary toilet per FRA code of federal regulations title 49, board award 458 article 17 section two, article ten, and most specifically side letter 10 that reads locomotives will meet minimum requirements of FRA and 458. The engine went through a BNSF mechanical facility and was not repaired.
